26 Jun APS takes TBX to court
A couple of weeks back Dan wrote a nice blog entry about TheBullExchange (TBX) found here.
Today a diligent investor posted the following summary on the IHUB of a lawsuit filed on March 27, 2012.
http://www.courthousenews.com/2012/03/27/45056.htm
Marketing Integrale which is a associated with AwesomePennyStocks (APS) is suing Todd Roberson aka Jeff Jeffries dba bestdamnstocks.com and thepennystockguru.com, William William, octbullmarkets.com, and thebullexchange.com, in Federal Court.
According to the complaint, on or around February 18, 2011, unidentified defendants have each/or while in acting in concert by the use of an artifice or scheme, successfully hacked into Marketing Integrale's server's hosted at its primarily servers located in the United States stealing Marketing Integrale's e-mail customer lists. The hackers then set up other websites to spam people using these lists.
This could help explain some of the enormous sucess that TBX had with the ECIT (now NRBT) pump and dump back around that same period of time.
Marketing Integrale seeks to have the courts identify who is behind TheBullExchange which has no name attached to it in the complaint.

This lawsuit is very similar to one that Eric Van Nguyen and Jay Fung filed a couple of years back:
Interesting stuff indeed!!

Posted at 18:30h, 26 JuneMesa Marketing’s response to the lawsuit (Motion to Dismiss):
https://viewer.zoho.com/docs/nccSCj
Mesa Marketing is allegedly linked to otcmarketbulls.com
otcmarketbulls.com was compensated to help support both the ECIT and AGRT promotions.
http://www.otcmarketbulls.com/disclaimer.html
ECIT
Marketbulls received $50,000 for one month’s marketing coverage for ECIT by a non affiliated 3rd party.
AGRT
Marketbulls expects to received $100,000 from a non affiliated third party for two months marketing coverage for AGRT.
Just like with The Bull Exchange (TBX), those are the only two tickers that have been promoted by otcmarketbulls.com.

Posted at 23:01h, 19 JulyThe dismissal isn’t a surprise at all. Reading through the original Complaint made it hard to imagine that any judge would grant the wishes of APS.
I think the lawsuit served its purpose. I think APS wanted to motivate the cyber sleuths to research and expose TBX and they accomplished that goal. If it wasn’t for the lawsuit I probably wouldn’t have been motivated to uncover who is really behind TBX and how the Paolucci family illegally ran a pump&dump on ECIT by controlling all sides of the promotion.
I think the lawsuit was also done as an attempt to try to hurt the credibility of TBX and I think that goal was also accomplished with the allegations of theft and cheating as the reason for TBX’s early success
APS obviously wants a monopoly atop of the penny stock pumping world and they’ll do whatever it takes to solidify their position as king of the hill
